TERMS OF SERVICE
The owner of the online store https://www.uitama.ee (referred to as the "Online Store") is Loovkulg OÜ (registry code 1671482) located at Lilleherne tee 30, 11914 Tallinn, Estonia.
VALIDITY OF SALES CONTRACT, PRODUCT, AND PRICE INFORMATION
- These terms and conditions apply to purchasing goods from the Online Store.
- The prices of the products sold in the Online Store are indicated next to the products. The price does not include the cost of delivering the goods.
- All prices are displayed in euros (EUR), and no VAT is added to the price. Loovkulg OÜ is not subject to VAT.
- The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
- Information about the product is provided next to the product in the Online Store.
ORDERING
- To order a product, add the desired items to the shopping cart. To complete the order, fill in the required fields and select a suitable product delivery method. Then the screen will display the amount to be paid, which can be paid by VISA or MasterCard card payment or via bank link (Montonio).
- The contract is forced upon receipt of the amount due to the Online Store's bank account.
- If, for any reason, the ordered goods cannot be delivered, whether due to stock depletion or any other circumstance, the buyer will be promptly informed. In such cases, a full refund, including the cost of delivery, will be issued without delay, ensuring that the buyer receives their reimbursement within 14 days from the date of notification.
DELIVERY
- Goods are delivered worldwide.
- The buyer can select their preferred delivery method, opting for either a parcel machine (DPD, Smartpost, Omniva, Venipak) or a courier service.
- The buyer bears the shipping costs, and the relevant price information is displayed next to the shipping method.
- Domestic shipments in Estonia generally arrive at the destination specified by the buyer within 5-7 business days from the entry into force of the sales contract. Delivery outside Estonia takes place within 30 calendar days.
- In exceptional cases, longer delivery times may occur, but the buyer will be notified as soon as possible.
RIGHT OF WITHDRAWAL
- After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
- The right of withdrawal does not apply if the buyer is a legal person.
- To use the 14-day right of withdrawal, the ordered product must not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the product in the same way as it would be allowed to test the product in a physical store.
- If the product has been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the product, or if there are signs of use or wear and tear, the Online Store has the right to reduce the refunded amount following the decrease in the value of the product.
- To return the goods, the buyer must submit a return form by email to info@uitama.ee no later than 14 days from receiving the goods.
- The cost of returning the goods is borne by the buyer, except in cases where the reason for the return is that the item to be returned does not correspond to what was ordered (e.g., wrong or defective item).
- The buyer must return the goods within 14 days of submitting the form of return or provide evidence that they have returned the goods within the same period to the carrier.
- The Online Store will refund the buyer immediately upon receiving the returned goods, but no later than 14 days from receiving the declaration of withdrawal, all fees received from the buyer under the contract.
- The Online Store may refuse to make refunds until it has received the goods back or until the buyer has provided proof that the goods have been returned, whichever occurs earlier.
- If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the additional cost exceeding the standard delivery cost.
- The Online Store has the right to withdraw from the sale transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked down due to an error.
RIGHT TO SUBMIT A COMPLAINT
- The online store is responsible for the non-compliance of the goods sold to the buyer with the terms of the contract or for deficiencies that existed at the time of delivery of the item to the buyer, which occur within two years from the delivery of the item to the buyer. Within the first six months from the delivery of the item to the buyer, it is presumed that the defect was present at the time of delivery of the item to the buyer. Rebutting this presumption is the responsibility of the Online Store.
- In the event of a defect, the buyer has the right to contact the Online Store within two months by emailing info@uitama.ee.
- The Online Store is not liable for defects arising after the delivery of the goods to the buyer.
- If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.
- The Online Store will respond to consumer complaints in writing or in a form that allows written reproduction within 15 days.
MARKETING AND PROCESSING OF PERSONAL DATA
- The Online Store uses the personal data provided by the buyer (including name, telephone number, address, email address, bank details) only for processing the order and delivering the goods to the buyer. The Online Store forwards personal data to companies providing transport services to deliver the goods.
- The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to receive them by entering their email address on the website and indicating their desire to receive direct mail messages.
- The buyer can opt out of receiving offers and newsletters sent to their email address.
- Loovkulg OÜ is the data controller responsible for processing personal data and may transmit the necessary personal data to the authorized processor Montonio Finance UAB for payment processing.
DISPUTE RESOLUTION
- If the buyer has any complaints regarding the Online Store, they should be sent to email to info@uitama.ee.
- If the buyer and the Online Store are unable to resolve a dispute by mutual agreement, the buyer may contact the Consumer Disputes Commission. - The Consumer Disputes Commission has jurisdiction to settle disputes arising from contracts concluded between the buyer and the Online Store. The examination of the buyer's complaint by the commission is free of charge for the buyer.
